HBO ON BROADBAND PRIVACY POLICY

Please read this HBO Broadband Privacy Policy carefully before using this online entertainment service. Access to and use of this online entertainment service and the software application (the “Software”) and website located at www.hboonroadrunner.com (the “Site”) associated with it (collectively, the “Service”) is provided by HBO Consumer Ventures, Inc. (“HBO,” “Us” or “We”) subject to the following.  References to “you” in this Privacy Policy may also include any sub-accounts established by you.

Your privacy is important to us. To better protect your privacy, we provide this notice explaining our online information practices and the choices you can make about the way your information is collected and used in connection with the Service. This Privacy Policy applies only to the Service, and covers information collected on or through or in connection with your use of the Service.  Other HBO sites have different privacy policies, so when visiting other HBO sites, please be sure to regularly check the Privacy Policy applicable to each site.

Any sub-accountholders will be required to agree to the terms of this Privacy Policy and the Terms of Use governing the Service at the time the sub-account is established.  If you choose to establish a sub-account for your minor child, you will be required to submit this information to establish a sub-account for such child, and you will be required to consent to the terms of this Privacy Policy on behalf of such child.  For more information on sub-accounts, please see the Terms of Use.

HBO reserves the right to modify the terms and conditions of this Privacy Policy or to change, modify or otherwise alter any feature of the Service any time in its sole discretion at any time.  Changes may be communicated to you via one of the following methods: (1) by posting a revised version of this policy at the alert notification feature of the Service; (2) by sending an e-mail alerting you to the revised Privacy Policy; or (3) by otherwise making the revised Privacy Policy available for your review.  Any modifications to this Privacy Policy, including, but not limited to, any modifications to the warranty disclaimers or limitations of liability contained herein, will supersede the prior provisions for all activity occurring after the revised version has been made available in the manner described above.  Your continued use of the Service after the revised version is made available constitutes your agreement to the revision.

1.            The Information We Collect

On certain portions of the Service, you are requested to provide personally identifiable information.  The personally identifiable information that may be collected at these pages includes only your e-mail address.  Personal information does not include business contact information (e.g., office address, telephone number) in those jurisdictions that recognize such information as not being personal information.  Personal information may be collected when you:  (a) create a Registered Account; (b) create sub-accounts linked to your Registered Account; (c) register for promotions or other features of the Service; (d) report any issues relating to the Service or your use of the Service; and (e) contact customer service.

We also may collect certain non-personally identifiable information when you visit the Site or access the Service, such as: the type of browser you are using (e.g., Netscape, Internet Explorer); the type of operating system you are using, (e.g., Microsoft Windows 2000, Microsoft Windows XP, Vista); the IP address of any of your Computer(s) which may be used to access the Service; certain information necessary for us to uniquely identify your Computer(s); the domain name of your Internet service provider (e.g., RoadRunner); referring/exit pages; date/time stamp; clickstream data; and pixel tags.  In addition, when you visit the Service our servers automatically collect information describing your use of the Service, including content accessed by you, page/screen visits, length of time viewing a certain page or program, how the content is viewed, etc.  You may also be asked to voluntarily rate the content you view on the Service.

2.            How We Use the Information

In addition to the uses described previously, we may use or share the information you provide about yourself with our affiliate, Time Warner Cable, to verify your eligibility to access the service fulfill your requests for our products, programs, and services, to respond to your inquiries about our offerings and provide customer service assistance, to customize your use of the Service based on your viewing patterns and areas of interest, and to communicate with you regarding the Service, verify the status of your Registered Account and provide you with information regarding changes or updates to the Service and special offers and promotions.

Please recognize that HBO and/or its vendors (such as mailing houses, or customer service vendors) may store this information, and may share this information with third parties as necessary to process your transactions and provide access to the Service by you and your sub-accountholders.  HBO may also use this information for internal review and analysis of the Service, the customer service process, and consumer comments.

We sometimes use this information to communicate with you, such as to notify you when we make changes to our subscriber agreements, to provide you with promotional information about HBO and/or the Service, or to contact you about changes to the Service, Software or other system requirements, your Registered Account with us, or any customer service requests submitted by you.

We sometimes use the non-personally identifiable information that we collect to improve the design and content of our Service and to enable us to personalize your experience in using our Service.  We also may use this information to analyze usage of the Service internally, in the aggregate to provide user ratings and other information to subscribers generally, to offer you content on the Service that we think you might enjoy, and to better assist with customer service.  We may also share such information in the aggregate to enable our affiliates to analyze usage of the Service and determine the viability of a launch of the Service by such affiliates.

We may disclose personally identifiable information in response to legal process, for example, in response to a court order or a subpoena. We also may disclose such information in response to a law enforcement agency’s request, or transfer such information to a successor of HBO or any person or entity that acquires ownership or control of HBO or the Service via any means.  In such event, you recognize that such successor, person or entity may make changes or modifications to this Privacy Policy, and your continued use of the Service constitutes consent to any such changes or modifications.

Personally and non-personally identifiable information may be shared with our affiliate, Time Warner Cable, to provide you with customer service support, to process verification of your eligibility to receive access to the Service, to analyze usage patterns to review how particular items of content are accessed and how often downloads are viewed.  Affiliates who have access to personally identifiable information are required to protect this information in a manner that is consistent with this Privacy Policy by, for example, not using the information for any purpose other than to carry out the services they are performing for HBO.

3.            Opting Out

If at any time you wish to opt out of receiving promotional materials related to the Service, we will provide an unsubscribe link at the bottom of each promotional e-mail you receive.  You can also click here for information on opting out from promotional e-mails; or go to the “manage newsletters” in the My Account section of the Service. Please keep in mind that opting out of promotional e-mails will not prevent you from receiving transactional e-mail correspondence related to, without limitation: the Service, your Registered Account and/or any sub-accounts, and the Software required to operate the Service.

You should note that in some instances, certain information or services can only be provided to you if personal information is provided.  If you elect not to provide such information or opt out of having your information shared, you may not be able to receive certain content or information.

4.            Collection of Information by Third-Party Sites and Sponsors

The Service may contain links to other sites whose information practices may be different than ours. Visitors should consult the other sites’ privacy notices as we have no control over information that is submitted to, or collected by, these third parties.

We sometimes may offer content (e.g., contests, sweepstakes, or promotions) that is sponsored by or co-branded with identified third parties. By virtue of these relationships, the third parties may obtain personally identifiable information that visitors voluntarily submit as a result of participation in such content or activities.  HBO has no control over these parties’ use of this information.  The Service will notify you at the time of requesting personally identifiable information if these parties will obtain such information.

5.            Cookies

To enhance your experience with the Service, we may in certain contexts use “cookies.” Cookies are text files we place in your computer’s browser to store your preferences. Cookies, by themselves, do not tell us your e-mail address or other personally identifiable information unless you choose to provide this information to us by, for example, registering for the Service. However, once you choose to furnish the Service with personally identifiable information, this information may be linked to the data stored in the cookie.

6.            Security

We take information security seriously and use reasonable physical, electronic, and managerial procedures to help prevent unauthorized access, maintain data security, and correctly use the information we collect online.

Of course, no data transmission over the Internet is 100% secure, and any message or information you send to the Service may be read or intercepted by others, even if there is a special notice that a particular transmission (for example, credit card information) is encrypted, so please be aware that you provide your personally identifiable information at your own risk.

Although we try to take measures to safeguard against unauthorized disclosures of information, we cannot assure you that personally identifiable information that we collect will never be disclosed in a manner that is inconsistent with this Privacy Policy.

7.            How You can Access or Correct Information

You can access the personally identifiable information that you have provided to the Service online, or correct factual errors in such information, at the My Account section of the Service.  You can also log on to the Service to access and update certain select items of personally identifiable information.

To help protect your privacy and security, we will take reasonable steps to help verify your identity before granting access or making corrections to any personally identifiable or billing information.

8.            Collection of Information by Children

HBO does not knowingly collect any personally identifiable information submitted to the Service from individuals under the age of 13.  As noted previously, a Registered Accountholder may establish a sub-account on behalf of a minor child for whom such Registered Accountholder is a parent or legal guardian.  In such case, we require the Registered Accountholder to provide the information requested for establishing a sub-account and to agree to the terms of this Privacy Policy on behalf of such minor child.

If you are a parent or legal guardian who has discovered that your child has registered for or accessed the Service without your consent, you can ask us to remove any unauthorized information provided by your child by contacting customer service at 1-800-236-1704.  Upon valid notice from you, HBO will make reasonable efforts to investigate and remove the information.  Please be sure to provide customer service with the Username, Password and e-mail address submitted by your child.  Please review the Terms of Use for information regarding how to cancel such subscription.
